OSHA cited a local company operating at the Port of Hampton Roads in the death of their employee as a result of the collision of two pieces of machinery used to move containers. The citation specified that the employer had failed to provide training and designate specific vehicular routes resulting, in part, in the death of their employee. At an informal conference a comprehensive package was presented refuting the citations allegations and demonstrating the Employers proactive efforts in safety meetings advocating implementation of traffic control devices at the marine terminal. The Employer gave notice of its intent to formally contest the citation. Upon review of the materials presented attorneys for the US Department of Labor agreed the Citation should not have been issued and withdrew both the citation and the penalty.
